Conditions of Sale

By purchasing Training Materials from Data Deliverance, you (the Customer) agree to be bound to the following agreement, which shall be governed by the laws of South Australia, Australia:

1. The Customer acknowledges that the provision by the Customer of training using the Training Materials is performed at the sole risk of the Customer.
2. Data Deliverance disclaims all warranties with regard to the content of the Training Materials including without limitation, warranties of merchantability and fitness for a particular purpose. Data Deliverance shall have no liability for special, indirect, incidental, consequential, tort or punitive damages, however caused, arising out of the use of the Training Manuals, whether or not Data Deliverance has been advised or is aware of the possibility of such damages.
3. In any case, the maximum liability of Data Deliverance shall be no greater than the cost of the training manuals purchased. Where such a limitation is prohibited by Law, the maximum liability shall be no greater than the minimum allowable liability specified by Law.
4. The Customer warrants that where software is used in the course of providing training using the Training Materials, such software shall be licensed in a manner that permits the training activities being performed.
5. The Customer agrees to fully indemnify Data Deliverance against all suits, claims and actions (including all costs incurred by Data Deliverance in defending or settling such suits, claims and actions) which may be instituted against Data Deliverance as a result of the Customer breaching clause 4 above.
6. The Training Materials are offered to training companies at very attractive rates for use in their educational activities. Except with express prior written permission, the Training Materials may not be resold, except to students attending courses run by the Customer in Australia. Data Deliverance currently has no resale partners in Australia, as it believes that selling directly to its Australian customers is in their best interest at this time. Training Materials may be purchased at retail prices with no resale restrictions.
7. Data Deliverance reserves the right to vary these conditions without notice. The conditions applying to a sale will be those which were published on the Data Deliverance web site at the time of the sale.
